Privacy Policy of LLC "Infinitas" (hereinafter – Privacy Policy) aims to provide natural persons with information on the processing of personal data, the purpose and basis of the processing, the duration of the processing, the categories of recipients of the personal data, the protection of personal data and the right of data subjects to access their personal data.

Personal data and their collection
Personal data is any information about an identified or identifiable natural person (hereinafter – Data subject) – potential/current/former client, guarantor, heir, payer, representative of these persons, contact person, other third party involved in the credit, t.sk. in the process of assessing solvency (for example, third-party data in the documents submitted by the client) and other data processing processes, the participant of the competition organized by the cooperation partners (t.sk. potential) of LLC "Infinitas", their representatives or true beneficiaries, candidates for the vacancy of LLC "Infinitas".
The categories of personal data that LLC "Infinitas" mostly, but not only, collects and processes are:

Identification data, such as name, surname, personal identification number, date of birth, identity document data (e.g. copy of passport, ID card);
Contact information such as address, phone number, email address;
Communication data collected when the Data Subject visits LLC "Infinitas" store or website www.gpspro.eu, or communicates with LLC "Infinitas" by phone, electronic means, news and other means of communication, such as social media, data obtained when the Data Subject visits the websites of LLC "Infinitas" or by contacting other LLC "Infinitas";
Service-related data, such as performance or non-performance of contracts, contracts concluded and terminated, applications, requests and complaints submitted, interests, service fees,
Data about participation in games and promotions, such as prizes won in games or promotions.

LLC "Infinitas" obtains personal data from:

the Data Subjects themselves;
representatives of Data Subjects;
cooperation partners of LLC "Infinitas" (for example, sellers of goods / services, organizers of the competition);
credit institutions when administering payments;
law enforcement agencies, courts, insolvency administrators, bailiffs, notaries.

Purposes of personal data processing

Receipt and processing of applications (applications for the purchase of goods or loan applications), as well as the provision of services of LLC "Infinitas";
Preparation, processing and execution of contracts/agreements and other documents (establishment, modification or termination of legal relations);
communication with the Data Subject, including informing him or her about any changes in the services of LLC "Infinitas", LLC "Infinitas" and / or information arising from mutual contractual relations;
ensuring and improving the provision of services, ensuring the quality of service;
conducting market research, statistics;
offering services to customers (marketing activities), organization of promotions and / or competitions;
development of new services;

Introduction of new technologies and maintenance of operation in order to comply with the requirements of regulatory enactments regarding identification of the Data Subject, prevention of illegal activities, prevention of money laundering and terrorism financing;
administration of payments;
organization of record keeping;
receipt and processing of applications/ applications/ claims and other documents, t.sk. providing answers;
assignment of the right to claim;
monitoring of public registers;
ensuring cooperation with cooperation partners, including transfer/receipt of information necessary for ensuring cooperation and provision of services;
auditing, planning, accounting and analysis of commercial activities;
preparation and provision of business reports and reports;
public authorities, t.sk. execution of requests from law enforcement agencies in accordance with the procedures specified by law;
Protection of infringed or contested rights or interests protected by law, including exercise of the right to claim, storage of evidence in case of a possible dispute with the Data Subject;
Identification and prevention of illegal activities, as well as reporting to the relevant authorities;
Fulfilment of duties specified in regulatory enactments (for example, regulatory enactments regulating accounting);
contributing to the promotion of responsible lending and responsible and fair borrowing.

Legal basis for the processing of personal data
LLC "Infinitas" processes personal data on the basis of the following legal bases for the processing of personal data:

Consent of the Data Subject to the processing of the Personal Data of the Data Subject;
conclusion and execution of the contract;
to fulfill the obligations of LLC "Infinitas" specified in the current regulatory enactments;
legitimate (legitimate) interests – for the realization of legitimate (legitimate) interests of LLC "Infinitas" arising from legal relations or regulatory enactments.

Accounting of natural persons who are involved in the data processing of LLC "Infinitas" (accounting of employees of cooperation partners of LLC "Infinitas");
monitor and prevent illegal activities, including fraud;
apply to law enforcement authorities and courts for the protection of their infringed or contested rights or interests protected by law;
to provide management, financial and business accounting and analysis of LLC "Infinitas";
keep documents;
manage the credit risk of LLC "Infinitas".

Processing of personal data and categories of recipients
The processing of personal data is carried out on the basis of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter - the Regulation) and other applicable laws and regulations in the field of privacy and data processing, taking into account the reasonably available organizational, financial and technical resources of LLC "Infinitas".
LLC "Infinitas" may disclose the personal data of the Data Subject:

cooperation partners of LLC "Infinitas", with whom together LLC "Infinitas" offers co-branded products and Services (to provide such Services and products, as well as for marketing and advertising of such products);
public authorities and other institutions/bodies performing their statutory functions;
statutory auditors/auditors, legal and financial advisers;
personal data processors contracted by LLC "Infinitas", who provide support in the provision of services of LLC "Infinitas" (for example IT service providers that help LLC “Infinitas” to provide, systematize and process personal data and ensure the operation and development of the website, including, but not limited to, cloud service providers, software developers; email delivery service providers that help send marketing communications to Data Subjects; service providers that help display personalized marketing communications; accounting and legal service providers);
managers of public registers;
debt collection companies, credit history research (credit information) offices and other third parties to whom LLC "Infinitas" may transfer its rights and obligations.

LLC "Infinitas" may disclose personal data to other third parties (independent controllers) in the following cases:

the processing of data is necessary for the conclusion and/or performance of a contract;
data processing is specified in the regulatory enactments, which are applicable in the activities of LLC "Infinitas";
the consent of the Data Subject has been obtained;
disclosure of data is necessary for the protection of the violated or contested rights of LLC "Infinitas" or interests protected by law.

Profiling of personal data, automated decision-making and commercial sending of offers

Profiling of personal data

Profiling is any type of automatic processing of personal data, which is carried out for the purpose of evaluating/analyzing certain personal aspects related to the Data Subject, such as the economic situation, personal preferences, interests, place of residence of the Data Subject. Profiling is used to perform analysis for consulting the Client, for direct marketing purposes, for automated decision-making, such as creditworthiness assessment, risk management, transaction monitoring to prevent fraud, and it is based on the legitimate interests of LLC "Infinitas", fulfilment of legal obligations, performance of a contract or consent of the Data Subject.
For marketing purposes, LLC "Infinitas" uses automated personal data analysis tools, including profiling of the Data Subject's data. LLC "Infinitas" performs grouping and analysis of the Data Subject's data according to the purchased goods, payment discipline and other criteria, taking into account other characteristics characteristic of the Data Subject (e.g., gender, date of birth, region of residence, etc.).
LLC "Infinitas" also performs data profiling in order to grant advantages to certain categories of customers (for example, customers who celebrate a birthday in a certain period of time).
The data subject's data analysis and profiling activities carried out by LLC "Infinitas" do not legally affect the Data Subject, because as a result of such actions LLC "Infinitas" does not take decisions binding on the Data Subject.
If, however, the Data Subject wishes to object to the automated grouping and analysis (profiling) of his or her personal data, the Data Subject has the right to object to the automated processing of data, including profiling, informing LLC. "Infinitas" about it to the e-mail address: askme@gpspro.eu or phone number: 27 057 057.
The data subject, when objecting to the profiling of personal data, should be aware that LLC. "Infinitas" will not be able to inform the Data Subject about the current offers and advantages of LLC "Infinitas" – promotions, news and other marketing activities in the future.

Sending a commercial communication

Data subjects who have submitted their personal data and expressed a wish to receive information about the current offers of LLC "Infinitas" – promotions, news and other marketing activities, do not object that to achieve the mentioned goal, representatives of LLC "Infinitas" will contact the Data Subject using publicly available electronic communications services (e-mail, telephone (phone calls and/or SMS)).
By giving consent to the use of the Personal Data of the Data Subject for direct marketing purposes, the Data Subject has the right to refuse such data processing at any time insofar as it is related to direct marketing, informing LLC “Infinitas” by email askme@gpspro.eu.
LLC "Infinitas" may offer its services to existing customers on the basis of legitimate interests.

Criteria for the duration of storage of personal data
LLC "Infinitas" stores personal data as long as at least one of the following criteria exists:

LLC "Infinitas" or the Data Subject may realize his or her legitimate interests, for example, to submit objections or bring an action in court, to file a creditor's claim, the case is not time-barred;
there is a legal obligation to store personal data, for example, keeping the company's supporting documents;
consent to the processing of personal data is valid, for example, the consent of the Data Subject to send a commercial communication.

Rights of the data subject
The data subject has the right to:

access your personal data at the disposal of LLC "Infinitas",
request to correct your personal data at the disposal of LLC "Infinitas", which is not accurate,
in the cases provided for in the Regulation, to request the restriction of data processing,
request the erasure of personal data in justified cases,
if the data processing is carried out only on the basis of consent, to withdraw your consent at any time (the withdrawal of consent does not affect the lawfulness of the data processing carried out until the withdrawal),
to object at any time to the processing of your personal data based on the legitimate interest of LLC "Infinitas", based on reasons related to the special situation of the Data Subject.
A request for the processing of your personal data and the exercise of rights with a specified postal address for receiving a response may be submitted by:
in person or by post as a signed application;
electronically by sending an e-mail and signing it with a secure electronic signature.

LLC "Infinitas" will evaluate the received request and provide a response in accordance with the applicable regulatory enactments.
